1) Scope of Application
1.1 These General Terms and Conditions (hereinafter "GTC") apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur (hereinafter "Customer") with the Seller regarding the goods presented by the Seller in their online store.
1.2 The Seller is ORBITOPIA FIGURES LTD, a private limited company registered in England and Wales under company number 17079949, with registered office at 5 Brayford Square, London, E1 0SG, United Kingdom. OrbiTopia is a trading name of ORBITOPIA FIGURES LTD (Company No. 17079949). Email: support@orbitopia-figures.com. Telephone: +44 7522 059701. The registered office is an administrative address only and is not a shop, warehouse or returns address.
1.3 The inclusion of the Customer's own conditions is hereby rejected, unless otherwise agreed.
1.4 A consumer in the sense of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity.
1.5 An entrepreneur in the sense of these GTC is a natural or legal person or a legally recognized partnership acting in the exercise of their commercial or independent professional activity when concluding a legal transaction.
2) Conclusion of Contract
2.1 The product descriptions in the Seller's online store do not constitute binding offers from the Seller but serve as a basis for the submission of a binding offer by the Customer.
2.2 The Customer can submit the offer via the online order form integrated into the Seller's online store. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the Customer submits a legally binding contractual offer for the goods contained in the shopping cart by clicking the button that concludes the ordering process.
2.3 The Seller may accept the Customer's offer within five days by sending an order confirmation in text form, by delivering the ordered goods, or by requesting payment after the order is placed.
2.4 When selecting PayPal as the payment method, payment processing is conducted via PayPal (Europe) S.a r.l. et Cie, S.C.A., under their applicable terms.
3) Right of Withdrawal
3.1 Consumers generally have the right to withdraw from the contract within 14 days without giving a reason.
3.2 Detailed information on the right of withdrawal, including who bears the cost of returning the goods and the return address, is set out in the Seller's Refunds & Returns policy.
4) Prices and Payment Terms
4.1 Product and checkout pages show the price, tax treatment, shipping charge and order total applicable to the selected market and delivery address. For cross-border orders, import VAT, customs duties or carrier handling fees are not represented as prepaid unless checkout explicitly identifies them as prepaid. Mandatory pricing and consumer-protection rules remain unaffected.
4.2 The payment methods available to the Customer are communicated in the Seller's online store.
5) Delivery and Shipping Conditions
5.1 Delivery is made to the delivery address provided by the Customer, unless otherwise agreed.
5.2 Orders are prepared and dispatched through third-party fulfilment partners. Depending on the product, availability and delivery destination, a parcel may be dispatched from outside the destination country. Handling takes 2-7 business days and transit a further 3-8 business days, approximately 5-15 business days in total. Estimates and available delivery services are shown on the product page or at checkout.
5.3 Returns are received at: OrbiTopia Returns, Bruenner Strasse 91/8, 1210 Vienna, Austria.
5.4 Import VAT, customs duties and carrier handling fees may apply to cross-border orders unless checkout shows them as prepaid.
5.5 If the delivery fails due to reasons attributable to the Customer, the Customer shall bear the reasonable costs incurred by the Seller.
6) Retention of Title
The Seller retains ownership of the delivered goods until the purchase price has been paid in full.
7) Liability for Defects (Warranty)
7.1 For contracts with entrepreneurs, the Seller has the choice of remedy and the limitation period for defect claims is one year from delivery of the goods.
7.2 For consumers, statutory warranty rights apply in full.
8) Redemption of Promotional Vouchers
8.1 Vouchers issued by the Seller as part of promotional campaigns can only be redeemed within the specified period.
8.2 Vouchers cannot be redeemed for cash or exchanged.
9) Applicable Law
9.1 These Terms and any contract concluded under them are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction.
9.2 If you are a consumer habitually resident in the European Union, the European Economic Area or elsewhere, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence, and you may also bring proceedings in the courts of your country of residence.
10) Alternative Dispute Resolution
10.1 The former European Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025. Information about consumer redress and recognised dispute-resolution bodies is available at Consumer Redress in the EU.
